SJN launch a convenient time for Mthethwa to call for release of CSA forensic report 0

While sports minister Nathi Mthethwa praised Cricket South Africa on Friday for the establishment of their Social Justice and Nation-Building (SJN) project, he also used the launch as a convenient time to call for the organisation to release the forensic report into fired former CEO Thabang Moroe and called for the election of fresh leaders at the AGM on September 5.

CSA on Friday announced that Advocate Dumisa Ntsebeza, a man of significant stature who has served as an acting judge, a Truth and Reconciliation commissioner and is a sought-after legal academic overseas, will be the ombudsman and face of SJN. They also announced nine ambassadors who will help foster the transformation and nation-building objectives of the project in their communities – former Proteas Dinesha Devnarain, Shandre Fritz, Gary Kirsten, Lance Klusener, Marcia Letsoalo, Nulubabalo Ndzundzu, Makhaya Ntini, Geoff Toyana and Monde Zondeki.

The good news of the SJN launch followed the day after Moroe was formally fired with immediate effect by CSA, having been suspended since early December. The CSA Board have refused to make public, even to their own Members Council, the forensic report upon which Moroe’s verdict of being guilty of misconduct was based, but Mthethwa said on Friday in an online address that he expects the organisation to table the report when they meet with him next week.

Many critics believe the CSA Board don’t want to release the report because they are implicated in the same wrongdoing for which Moroe was dismissed.

“I am pleased with the move to establish the SJN project, it is a step in the right direction in the fight for transformation and they heave heard the cries of their ex-cricketers and listened to people like former president Ray Mali on how hurt he is about cricket. This will fight any sort of exclusion, South Africa is so rich in talent but we are not employing our full capacity.

“But when we meet next week for me to respond to CSA’s turnaround plan and the corrective steps they are going to take for the challenges they are facing, I also expect them to share with me and government the forensic report they promised last year to show me when it was available. I look forward to that and then the AGM is in CSA’s hands.

“But the leaders elected should be beyond reproach. Government would frown upon people being elected with questionable credentials. There is a cloud gripping cricket and they definitely need to make a clean move away from that. I would not be happy with a process that is opposed to that,” Mthethwa said.

The irony of a government minister saying CSA should not elect leaders of dubious integrity was exacerbated by where the launch was held, which will also be the location of the ombudsman’s office – Olympic House – the home of Sascoc, themselves embroiled in numerous governance scandals.

Nevertheless, Dr Eugenia Kula-Ameyaw, the CSA independent director in charge of transformation, had reason to be enthusiastic about the new body they have rapidly formed in response to the racial storm that has tarnished South African cricket. But despite the impressive figure in charge of SJN and the good intentions shown on Friday, the power that will determine the success of SJN, and whether it will actually improve the lot of future marginalised cricketers, lies with the CSA Board.

“The ombudsman will recommend to the Board what action should be taken, but the aim of the SJN is to engage, heal and restore. If we are mature enough then we can find something positive out of what is revealed, we do not want a legalistic approach. We will be looking at legacy issues and the lessons from the ombudsman will inform how we move forward. “We will support transformation in the rural areas, aggressively, and it’s all about how we make sure those issues do not happen again. The SJN will be integrated with the transformation committee, but as someone said, our future cricketers are not born to be part of what failed. This time around we really will transform and we have to make sure that it is not just on paper but seen on the field,” Kula-Ameyaw said.

Call for legal action highly unlikely to happen 0

There seems to have been some misinterpretation of Jurie Roux’s comments this week to the extent that the Australian Associated Press news agency claimed that the SA Rugby CEO had made the call for legal action to be taken against New Zealand Rugby for their plans to basically pull out of SuperRugby as we know it.

The truth is likely to turn out to be almost the opposite. While Roux did say “New Zealand have kicked themselves out”, he also added that they had “every right to determine their own future” and that discussions were happening with all Sanzaar partners.

You see, the Covid-19 pandemic would almost certainly qualify as a ‘force majeure’, the trendy new legal term borrowed from the French for what we used to call Acts of God. A ‘force majeure’ is an unforeseen and uncontrollable circumstance that makes it impossible to fulfil a contract.

In terms of rugby, it is clearly impossible for SuperRugby in its usual format to happen in 2021 if international travel is not yet allowed, if there are strenuous quarantine measures still in place or if the paucity of flights makes overseas trips prohibitively expensive.

Roux did say that there are Sanzaar legal agreements in place and that if anyone ignored their commitments to them then they would be liable to legal action, but with that French word coming into play, it would clearly take some pretty soulless leadership to try and sue a union that is just trying to keep themselves afloat in this time of economic catastrophe.

The shoe is on the same foot when it comes to South Africa because even if New Zealand wanted to proceed with SuperRugby as per normal next year, our franchises probably wouldn’t be allowed into the country without quarantining for two weeks and the costs of travel would be unaffordable.

Roux is a shrewd man as well and, although he has never publicly dissed the brand, he would have been well aware that the current SuperRugby format had lost the support of the general rugby-loving public and was busy pushing SA Rugby into poverty. He admitted this week that for more than a year he has been looking at additional options for SA Rugby and said “we are a long way down that road already and some of those options probably suit us better”.
This surely means a move into the lucrative Northern Hemisphere market. The Springboks and our top four franchises have plenty to offer European competitions as well – it is not as if we are the peasants of the game, we are the world champions and one of the biggest broadcast markets for rugby in the world.

But while SuperRugby may well be discarded like the old, worn out pair of boots it is, there is no doubt South Africa want to maintain a good relationship with New Zealand, traditionally their greatest rivals. Roux spoke about how the Rugby Championship is not only a significant revenue-earner for SA Rugby but it also enables them to cross-subsidise so many of their other competitions.

Those Sanzaar legal agreements are going to force New Zealand, Australia and South Africa, and Argentina, to the negotiating table to thrash out whatever win-win-win solution they can come up with. Leverage is always the name of the game when it comes to negotiation and while South Africa have the numbers and therefore the money to bring to the table in a big duffel bag, and New Zealand also have a large bag based on their historical record as having the best teams in southern hemisphere competition and therefore the biggest drawcard, it would seem Australia and Argentina only have sachets to barter with.

Nobody would want Australian rugby to be isolated like their country was before James Cook arrived with his cutlass, but the fact is they are not in a position of strength when it comes to negotiating the future of Sanzaar.

It is not too surprising that New Zealand do not want to accommodate all five Australian franchises, but if allegations that they have been in clandestine contact with a couple of them are true then that would be as offsides as the former SA Rugby president who fired the Springbok coach by fax.

Whatever comes of the negotiations, though, it would seem South African rugby fans can look forward to a stronger Currie Cup-type tournament locally, a refreshed, shorter, crossover event with the other Sanzaar teams and more of our franchises dunking their toes into European competition.

With the British and Irish Lions touring here next year, the stars of the UK game could become the same sort of attractions/nemeses as the likes of Dan Carter, Christian Cullen, Richie McCaw and Stephen Larkham.

And given the time zone, watching our teams playing in Europe will be much easier for those of us who tend to suffer from moderate dysania.

The clarion call for the CSA board to resign must still ring out 0

Amidst these tumultuous times in South African cricket it does seem like acting chief executive Jacques Faul and interim director of cricket Graeme Smith have brought some stability, but it is vital that fans and stakeholders of the game in this country do not forget the reasons for the crisis that led to their appointments and the clarion call for the Cricket South Africa board to stand down must still ring out loud and clear.

There is the danger that because of the sterling work done by Faul and Smith, people think everything is suddenly hunky dory with South African cricket. The battle against the Covid-19 pandemic has also provided a timely distraction for the incompetent, self-serving board to hide behind.

But an expected loss of a billion rand and the poor governance and thoroughly undemocratic behaviour of people like suspended CEO Thabang Moroe and president Chris Nenzani happened on the board’s watch. Many of them were active participants and supporters of #CricketCapture, the rest turned a blind eye and were in breach of their fiduciary duties as directors.

So far, the board has shown no intention of accepting accountability for their gross dereliction of duty to the game.

The big problem in South African cricket, however, is that the governance structure is all wrong and that makes getting rid of the parasites on the board a tough task.

The problem dates back to 2013 and CSA’s reaction to the Gerald Majola Bonus Scandal and the Nicholson Commission’s findings which eventually forced the board to get rid of the then chief executive. But CSA did not follow the commission’s recommendation that independent directors make up the majority on the board. Instead, CSA implemented a new system where five independent directors were elected on to the board alongside seven non-independent directors.

Those seven non-independent directors also sit on the Members Council, a 14-member group that elects the board and, according to CSA’s Memorandum of Incorporation, is the only structure that can dissolve the board.

The seven non-independents are elected from the 12 provincial presidents and CSA also devised a system whereby provincial presidents sit on the Members Council for three years, and can also serve a second three-year term.

So you can see the problem?

With the resignation of Gauteng’s Jack Madiseng as a director, six of the seven non-independent board members also sit on the Members Council that will vote on their fate. So it means at least seven provincial presidents have to vote against them.

But many of those provincial presidents have been part of the problem because they sit on the Members Council for three years. The old saying of turkeys voting for Christmas springs to mind.

A quick survey of the 12 provinces suggests four that would probably vote for change – Gauteng (Madiseng) and KwaZulu-Natal (Ben Dladla) apparently have their mandates already, North-West are currently under the administration of Archie Pretorius, one of Majola’s critics who was kicked off the board during the 2013 sham, and Western Province, who have a new president in Nic Kock, an advocate who has not been scared to take on CSA already in his short term in charge at Newlands.

But Eastern Province are led by a massive supporter of the Moroe/Nenzani axis in Donovan May, Boland have also been a backer through their president, Angelo Carolissen, although his second three-year term should be coming to an end soon. Border have a new president in Simphiwe Ndzundzu but sympathy for Nenzani would be understandable because he comes from the Bisho area.

South-Western Districts also have a long-serving president in Rudi Claassen, as do Free State (Zola Thamae, one of the directors) and Northern Cape (Rihan Richards). Northerns seem unsure of how to vote, mostly because their president, Tebogo Siko, has been newly elected on to the board and should not be blamed for the crisis. Easterns also have a new, young president in Xolani Peter Vonya.

Nenzani and his vice-president Beresford Williams, who has also strongly supported the regime, also have votes on the Members Council.

So because clubs wanting change in some provinces still have to wait two more years before they can outvote their president, change will be slow in coming via the traditional route.

Which is why I would call on any angel investors looking to get involved with Cricket South Africa to stipulate in their contracts that their sponsorships are dependent on the board changing.

And companies like Momentum need to follow through on their earlier ultimatums that they will withdraw their support unless the CSA board resign.

What will hopefully become a new era in South African cricket administration also desperately needs a change in governance structure so we don’t get into this sort of mess again. They had a chance in 2013 to get it right, hopefully in 2020 that chance will be taken and not dropped like a sitter at mid-off.

Hockey milestones reached, Damons aims for new goals 0

The lure of 200 Test caps was strong, but with the excitement of getting engaged, the approach of her 30th birthday and the new teaching job she has started, South African women’s hockey star Sulette Damons decided to call time on her illustrious career last week after making 198 appearances for the national team.

Robin van Ginkel, the new coach, recently held the second training camp of the year and the women’s national team is going to be a different, less exuberant environment without Damons, who was as loved off the field for her personality as she was respected on it, being one of the co-captains for last year’s World Cup, the most recent action the team saw.

“It would have been nice to reach 200, but I reached what I needed to and I played in three Commonwealth Games, three World Cups and an Olympic Games, so I feel like I’ve done all I could. I am getting older and I feel it’s the right time to concentrate on my career as a teacher and I’ve just got engaged as well,” Damons told Saturday Citizen.

Blessed with terrific pace and ball-skills, Damons played on the wing and scored and set up many goals for South Africa. The child of a domestic worker, Damons feasted on every opportunity that came her way and is truly an inspirational transformation success story.

Raised in the Umasizakhe township in Graaff-Reinet, Damons’ life changed when the family who employed her mother, Frances Buffels, funded her schooling at Union primary and high schools. The brilliance that lay within her DNA was soon recognised and she captained both her school and the Eastern Province hockey teams.

Damons then won a bursary to the University of Potchefstroom (Pukke) and was chosen for the SA U21 team in 2008, before making her debut for South Africa in 2010, at the World Cup in Rosario, Argentina.

She made the most dramatic of entrances into international hockey as well, scoring the winner against Spain.

“My favourite goal was most definitely the one on debut in the 2010 World Cup, my first international goal, against Spain. It was the winner and it was South Africa’s first win at the World Cup in a long time, so it was my best goal ever.

“Captain Marsha Marescia was at halfway and I just saw a gap so I started sprinting and she hit a backsticks aerial pass over everyone, and it was just me and the goalkeeper in the circle. I put my stick out and I don’t know how, but by the grace of God the ball hit it and went in!” Damons recalled.

She tended to do well in World Cups and another of her favourite memories is scoring in the 4-2 win over England in the 2014 World Cup at the Hague, in her 150th game for South Africa.

Having qualified with a B.Ed, Damons is now teaching Grade IIIs in Bloemfontein, where her fiancé lives, at St Michaels School for Girls. Obviously they have got her involved in hockey as well, and she coaches the U13A side. A career in coaching might just lay ahead.

“Once I find my feet in coaching, maybe I’ll look to take it further. For now I still want to play a bit, for both my club and province, and hopefully I can play in the Premier Hockey League [PHL] as well,” Damons said.

Never mind her coaching expertise, Damons’ life story is enough to inspire and she says her success was all about exposure, and believes that is the answer to the all-important transformation questions facing South African hockey.

“Transformation is important because there is a lot of talent in this country and a lot of players are talented enough to reach what I did. The potential is there but it’s all about exposure, which is why the PHL is great, it allows the up-and-coming prospects to play with experienced players. We just need to make sure there are enough tournaments for these players,” Damons said.

And while the national team bombed out at the first stage of last year’s World Cup, finishing 15th out of 16 teams, Damons said all is not doom and gloom in that department, with change afoot.

“The change of coach was good and they’ve had a good start to the year under Robin, plus there’s more staff and a bigger squad now, it’s not just the same people over and over. There’s a lot of youth in that squad so that’s very healthy, it ensures the senior players don’t feel too comfortable because now there’s more competition.

“The youngsters are hungry and want experience. The biggest issue though is finances and if you don’t have that you can’t compete and we’ll still be behind the other teams. But if they can fix that and have more training camps and tours then they will be okay. The difficulty is hockey is an amateur sport in South Africa and we need players who are willing to take unpaid leave or put their studies on hold,” Damons said.

But if stories like Damons’ – a life transformed and now she is busy transforming other lives – don’t inspire support for hockey then it is difficult to know what will.
