The postponement of Cricket South Africa’s hearings for their Social Justice and Nation-Building project offers the ombudsman, Advocate Dumisa Ntsebeza, the opportunity to sort out the procedural problems that would have occurred if public hearings had gone ahead as scheduled on Monday.

CSA announced at 10pm on Sunday night that the opening day of proceedings had been postponed to ensure a fair and transparent process for all who are involved. “It has become clear that there needs to be clarity regarding the process of any public hearings. Failure to do so may compromise the legitimacy of any process embarked upon. My office will therefore be taking legal counsel as regards a proper process for any such hearings. I therefore welcome the postponement to ensure such procedural fairness,” Ntsebeza said in a statement.

Chief among the procedural problems that need to be sorted out is that it is believed the terms of reference for SJN say any hearings need to be private and confidential. But Ntsebeza wants public hearings and has reportedly even tried to get the SABC to broadcast them.

Public hearings could create other major problems for Ntsebeza and CSA because if any participant makes libellous allegations, it would open the organisation to legal action. There is apparently no scope for cross-examination in the terms of reference.

Former players like Ethy Mbhalati and Thami Tsolekile, both of whom are currently banned for their involvement in matchfixing, last year made public utterances alleging racism in cricket, but when there were shown to be holes in their testimony, they failed to back their allegations up with any evidence. They also tried in vain to reopen their matchfixing cases.

Some of the targets of accusations of anti-transformation bias have expressed concerns that SJN public hearings could become a free-for-all, where untested allegations are made, resulting in a form of mob justice.

Faf du Plessis has seen the Proteas crumple in more World Cups than is probably fair for one player to have to go through and yet the veteran former captain is still excited about the prospect of playing in two T20 World Cups in the next 20 months and even maybe the next 50-over tournament, scheduled for 2023.

It was revealed on Tuesday that Du Plessis will no longer be one of the 16 contracted Proteas for the coming year, but he told The Citizen on Wednesday that this was expected because he is only available for T20 cricket this year.

“I’m only available for T20 cricket this year as I mentioned in my Test retirement statement. I haven’t heard any communication from CSA regarding contracts, but I know they are looking into getting us involved in T20 cricket because there are two World Cups in that format in the next two years. Two T20 World Cups in a row is going to be fire [emoji],” Du Plessis said in a WhatsApp.

India will host the next T20 World Cup in October/November this year, while Australia, who were due to hold the event last year before the Covid-19 pandemic arrived, will stage the tournament at the same time in 2022.

“There isn’t much ODI cricket this season and the ODI World Cup is only in 2023. Next season might be different in terms of games and also then the 2023 World Cup preparation, but for now with it being so far away, it’s better to build with players that can gain plenty games under their belts,” the 36-year-old added.

Du Plessis averages 57.87 in his 23 50-over World Cup appearances at the 2011, 2015 and 2019 tournaments, while he also played in the 2013 and 2017 Champions Trophy events. He also played in three T20 World Cups, in 2012, 2014 and 2016.

Du Plessis, who has been a stalwart of the Indian Premier League with 84 appearances, has previously indicated he is eager to play in more global T20 leagues around the world. Following the Proteas tour of Pakistan, he played three matches for Quetta Gladiators in the Pakistan Super League before that tournament’s suspension due to a spate of Covid-19 cases.

Whatever holiday time he has had since then will be drawing rapidly to a close as the next edition of the IPL is due to start on April 9.

Not even calling in the service of government to grant the Australian cricket team VIP travelling status to South Africa was enough for Cricket Australia (CA), as they pulled the plug on their scheduled three-Test series against the Proteas on Tuesday.

Cricket South Africa (CSA) released a statement on Tuesday recording there “immense disappointment” at CA’s decision, which they described as “regrettable”. In the diplomatic world of corporate press statements, this was a strongly-worded criticism.

Which was not surprising considering how CSA have bent over backwards to try and accommodate the Australians.

Apart from granting the Australian touring party VIP passage to and from the airport, CSA had also offered up the Irene Country Lodge for their exclusive use, meaning the Proteas would have moved to a different hotel. They have also altered their travel plans for the ongoing Pakistan tour, bringing the Test squad back early and sending a second-string outfit for the T20 series.

“The protocols we had proposed to CA were unprecedented. Firstly, we had agreed that our own Proteas team would enter the bio-secure environment [BSE] 14 days prior to the arrival of the Australian team, thus altering our planning during the current tour of Pakistan. Amongst some of the other key arrangements made were that all four areas – two hotels and two venues – had a protocol to implement a strict BSE with no contact with anybody outside this area. 

“We subsequently agreed to two separate BSEs and had granted Australia full and exclusive use of the Irene Country Lodge, which we shared with Sri Lanka, with a minimum staff present on site. In terms of the arrangements, the Proteas were to move to a separate hotel altogether. Furthermore, all hotel staff, match officials and even bus drivers were to enter the BSE 14 days prior to Australia’s arrival. 

“In addition, CSA had also committed to importing an Australian tracking system at great cost to ensure proper tracking of close contacts in the event of a positive test. The touring team was also going to be granted VIP access through the airports, after government intervention to ensure this privilege. These are just some of the protocols that CSA was to put in place. We had really gone the extra mile to make sure that the tour would proceed,” CSA’s chief medical officer Dr Shuaib Manjra said.

Given the suspicion of CSA’s BSE protocols, which have enabled them to host a Test series against Sri Lanka without incident, and a visit by England in which none of the touring players contracted Covid-19, as well as stage the Momentum One-Day Cup in Potchefstroom without a single positive test, it seems South African cricket’s station in global cricket in the near future will be a long way removed from the Big Three of Australia, England and India.

“It is indeed sad that after all the engagements and effort made to ensure a secure visit by our Australian counterparts, the tour has been derailed. CSA has incurred significant costs related to the planning stages and the cancellation of the tour represents a serious financial loss. In this challenging period for cricket and its member countries, we believe the stance taken by CA is regrettable and will have a serious impact on the sustainability of the less-wealthy cricket-playing nations,” CSA acting chief executive officer Pholetsi Moseki said.

Given how late CA have pulled out – they were due to arrive in two weeks time – those losses are estimated to be around the R50 million mark.

The first ODI between South Africa and England scheduled to be played at Newlands from 1pm on Friday has been postponed due to a positive Covid-19 test and will now be held at Boland Park’s scenic surrounds on Sunday.

Cricket South Africa confirmed on Friday, only an hour before the match was scheduled to start, that a member of the Proteas team had tested positive for Covid-19 in the final round of testing which was done on Thursday. While that player obviously goes straight into isolation, everyone else who has been in close contact with him now also has to quarantine or be re-tested.

The bottom line is that the entire series, which was meant to end on Wednesday, is now in doubt because South Africa only have a squad of 18 players in the bubble. The potential loss of revenue from the three ODIs being cancelled is something the professional game in this country can ill afford.

According to the CSA statement, England and Wales Cricket Board CEO Tom Harrison has agreed to the first ODI being postponed rather than cancelled. Sunday’s second game in Paarl will now become the opening 50-ovr fixture, with the Newlands match now being played on Monday and Cape Town also hosting the third match on Wednesday.

Sunday’s fixture is a day game while the last two matches are day/nighters.

Both teams have been tenants of the luxury Vineyard Hotel in Cape Town, in a strictly-controlled bio-bubble, but the Proteas had two players – believed to be David Miller and Andile Phehlukwayo – test positive for Covid before the T20 series between November 27 and December 1.
